Service terms
These terms set the operating boundary for authenticated accounts, prepaid credits, handset-backed transport, and responsible use of Australian SMS infrastructure.
Sent means the handset reported a carrier attempt. A receipt is a separate event and is not inferred from a successful send.
Your account
Keep sign-in details and API keys confidential, provide accurate account information, and tell AussieSMS promptly if a credential or connected device may be compromised. You are responsible for requests made with your active credentials.
Permitted messaging
Use the service only for lawful messages to recipients you are authorised to contact. Do not send fraud, harassment, malware, unlawful content, or unsolicited commercial messages. For commercial messages, the sender remains responsible for consent, accurate sender identification, contact details, and a working unsubscribe process.
Read ACMA guidance on consent, sender identity, and unsubscribe
Credits and checkout
Current package prices are displayed in Australian dollars. A credit is deducted after an authenticated request is accepted into the queue. Stripe Checkout processes card payments. A checkout return page is not, by itself, proof that credits were applied; the signed payment webhook and account ledger are the system records.
Status and delivery
Queued means accepted into the service queue. Claimed means a gateway took responsibility for the row. Sent means the handset reported a carrier send attempt. Delivered requires separate receipt evidence. Failed means the send attempt did not complete. Carrier networks, recipient devices, and handset availability remain outside the web application boundary.
Service protection
AussieSMS may rate-limit, suspend, or close access needed to protect recipients, the network, connected devices, other accounts, or the service. Automated attempts to bypass account, credit, or send controls are prohibited.
Who you are contracting with
The service is supplied by Leigh Hepenstall-McMillan, ABN 62 105 083 720, of 37 Ninth Street, Wingfield SA 5013, Australia, operating as AussieSMS within the NearMe network. These terms are governed by the law of South Australia.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Privacy and support
The privacy notice describes the operational information handled by the service. For account, billing or technical support, email support@nearme-ads.com. Do not send credentials, payment details, or personal information to an address not presented on this site.
